1. Scope of Application
These General Terms and Conditions apply to all bookings and rentals of the premises and studios provided by Firstlocation.
They apply to both private overnight stays and commercial uses such as workshops, film and photo productions, seminars, or similar events. These Terms and Conditions also extend to all additional services requested and booked via the Signature Service (Signaturservice).
2. Conclusion of Contract
A binding contract is concluded upon the acceptance of a booking by Firstlocation. For online bookings via the provided booking platform, the contract is deemed concluded upon receipt of the booking confirmation. For corporate clients, the contract is concluded upon the signing of an offer, order, or location agreement.
The following applies to the Signature Service: Inquiries via the online form are initially non-binding. A legally binding contract for these additional services is only concluded upon a separate written confirmation or invoicing by Firstlocation.
3. Terms of Payment
Payment processing for online bookings is handled via the external booking system "Lodgify" (Smarter DM SL, Barcelona). The payment methods offered in the booking process and the corresponding payment deadlines are bindingly agreed upon conclusion of the contract. For corporate clients paying by invoice, the amount is due immediately upon conclusion of the contract, unless otherwise agreed. In the event of late payment, Firstlocation reserves the right to charge dunning fees and default interest in accordance with Section 288 of the German Civil Code (BGB).
4. Right of Withdrawal
For private guests, the statutory right of withdrawal of 14 days for distance selling contracts applies, provided the booking does not concern a specific date commitment (e.g., holiday stay or fixed booked event period). In these cases, there is no right of withdrawal pursuant to Section 312g (2) No. 9 BGB.
5. Cancellation Policy and Cancellation of Additional Services
For online bookings of the studios, the cancellation conditions of the respective offer stored and confirmed in the booking process apply.
Special conditions for the Signature Service: Cancellations of already confirmed additional services (in particular catering, pantry service, or externally booked service providers) must be made in writing no later than 72 hours before the agreed time of arrival or use. In the event of later cancellations or no-shows, Firstlocation reserves the right to invoice 100% of the costs for goods and services already procured. If the main booking is cancelled, the Signature Services linked to the main booking are automatically deemed cancelled as well. The 72-hour deadline also applies here to any claims for damages for expenses already incurred.
6. Use, Liability, and Duty of Care
The rooms may only be used in accordance with the agreed purpose of use. The tenant is liable for all damages caused by them, their guests, or commissioned third parties. For slight negligence, Firstlocation is only liable in the event of a breach of essential contractual obligations (cardinal obligations), limited to the typical, foreseeable damage.
7. Liability for Defects
Should defects occur in the rented property or the additional services, Firstlocation must be informed immediately. There is a right to rectification or, if this is not possible, to compensation. Further claims are excluded, unless gross negligence or intent is involved.
8. Signature Service and External Service Providers
Additional services from our Signature offer (such as technical equipment, catering, props, daily cleaning, etc.) can generally only be claimed in connection with an existing or simultaneous main booking of the premises. There is no isolated entitlement to these services. Firstlocation reserves the right to have certain additional services, such as catering or special services, carried out by external service providers.
9. Jurisdiction
German law applies. The place of jurisdiction for all disputes arising from the contractual relationship is Hamburg.
10. Severability Clause
Should a provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid clause shall be replaced by a provision that comes closest to its economic purpose.
